OFFICIAL CONTEST RULES
NO PURCHASE NECESSARY. YOU MUST BE A BRITISH COLUMBIA RESIDENT 19 YEARS OF AGE OR OLDER TO ENTER.
The following promotion is intended for play in British Columbia, Canada only and will be construed according to applicable British Columbia and Canadian laws. Please do not enter if you are not located in British Columbia, Canada.
1. HOW TO ENTER
Contest begins on October 15, 2007 and ends on December 31, 2007. To enter, visit www.cookingwithcream.com prior to 11:59 p.m. Pacific Time December 31, 2007 and complete and submit the online entry form and you will be automatically entered for a chance to win. Limit one entry per person
If nominating a person other than yourself for contest entry (in accordance with the rules set out below), when submitting such entry, please include (in the space provided) the name and contact information of the person you would like to nominate for contest entry. That person will then be contacted to verify their consent for entry in the contest. Their entry will not be accepted until consent is received.
There are two steps to participate:
- You must first register on Contest web site at the following link: http://www.cookingwithcream.com ("Contest Site") by providing your first and last name, email address, phone number and address. If you are nominating another person for contest entry, you must also provide their information as requested on the form.
- After completing the registration, you must also submit a description of no more than 200 words and other audio/visual materials (collectively, the "Submission"), in accordance with the Submission Requirements below, demonstrating how you are deserving of a "recipe makeover" (i.e. you've never learned to cook, you burn everything, you only typically have packaged foods in stock). If you are not a bad cook or not in need of a recipe makeover, but you know of a friend or family member or colleague who is, you may nominate that person (a "Nominee") by including a Submission describing how that person is in need of a recipe makeover. See the Section below titled "Nominating a Friend" for the applicable terms.
In addition, your Submission must meet the following submission requirements ("Submission Requirements"):
- It must contain a short description explaining how you (or your Nominee) is a bad cook or in need of a recipe makeover. The description may not be longer than 500 words.
- It must be original, written in your own words and may not have been copied from any other source.
- It must be in English only.
- Only one (1) file may be submitted in either jpg, gif, or png format with a maximum file size of 500kb
- It may not include any content or material that is owned, licensed or subject to any rights of any third party, including any copyrighted material, logos, trademarks, trade names or service marks.
- It cannot contain any personally identifiable information, including names, street or e-mail addresses, or phone numbers, of any person other than you or your Nominee.
- If you are nominating a Nominee in a Submission, you must ensure that you have permission and consent in writing from that person to provide the personally identifiable information that you include in the Submission and that BC Dairy Foundation has all rights to use the Submission in the manner described in these Official Rules.
- You must have permission to use or display the likeness or image of any person or group that appears in the Submission.
- It cannot contain any content or material that is defamatory, abusive, offensive, derogatory, obscene, threatening, sexual or that otherwise discriminates on the basis of race, religion, creed, national origin, disability, handicap, age, sexual orientation, marital status, veteran status or any other basis prohibited by law or otherwise inappropriate, as determined in the sole discretion of the Sponsor.
- It cannot directly promote or speak negatively about any particular faith, political action, legislation or party or encourage the violation of any law, as determined in the sole discretion of the Sponsor.
NOTE: Submissions that do not meet these Submission Requirements are not eligible and will be disqualified from the Contest.
After developing your Submission, you must submit it to the Contest Site. Submissions will not be accepted if sent by mail, fax, in person, or by any other method. Although online access and a valid e mail account are required in order to participate in this contest, no purchase of any kind is required. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free e mail accounts.
All Submissions become the property of Sponsor. They will not be returned or acknowledged. Proof of submission does not constitute proof of receipt. Sponsor is not responsible for lost, late, misdirected, incomplete, damaged, irregular, altered, garbled, infected, or illegible Submissions, which will be deemed void, or for any computer-related, online, telephonic, or technical malfunctions that may occur.
NOMINATING ANOTHER PERSON
If you would prefer to nominate a Nominee rather than yourself to enter this contest, simply complete the first step of the entry process and, when you get to step two, rather than developing a Submission explaining why you are in need of a recipe makeover, your Submission can explain how your friend is so in need.
Furthermore, by nominating a Nominee you warrant and represent that that person meets the eligibility requirements for this Contest. If your submission about a Nominee is selected to win, the prize will be awarded in the name of your Nominee and he or she will have the ability to select the prize, as described in more detail below. You will have no right, title or interest in or to the prize, which shall belong solely to your Nominee. Before nominating any person, you warrant and represent that (s)he has consented to your providing BC Dairy Foundation with his or her name and email address and that (s)he permits you to send BC Dairy Foundation a photograph or video showing him/her. After you nominate your Nominee, (s)he will be sent an email by BC Dairy Foundation that will require him/her to agree to the terms of these Official Rules and BC Dairy Foundation's privacy policy in order to be eligible to receive a prize in this Contest. If you do not have your Nominee's permission to supply BC Diary Foundation with this information, please do not nominate that person.
LIMIT one (1) entry per person. You may enter for yourself, or nominate another person as your Nominee, but not both.

2. ELIGIBILITY
Entrants must be legal British Columbia, Canada residents who have reached the age of majority (19). Employees of British Columbia Dairy Foundation ("Sponsor"), its affiliates, marketing partners, suppliers, advertising or promotional agencies, and the immediate family members (mother, father, brother, sister, son, daughter, spouse) of, or persons residing in the same household as, such persons, are not eligible. All provincial and local laws and regulations apply. Odds of winning are dependent upon the total number of eligible entries received. Participation in this Contest constitutes contestant's full and unconditional agreement to and acceptance of these Official Contest Rules. Participants who do not comply with these rules are subject to disqualification.
3. HOW TO WIN:
Contest entries will be profiled online at the Contest Site. Visitors to www.cookingwithcream.com may vote for their contest entrant of choice by completing all required fields of the online voting form in accordance with the online instructions. Votes submitted in accordance with those official Rules shall be hereinafter referred to as "Eligible Votes". Limit one (1) vote per person per day. If a voter uses multiple e-mail addresses to submit more than one vote online, only the first online vote per day will count. In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential voter may be requested to provide the Sponsor with proof that the potential voter is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, the Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the voting process, and to cancel, terminate, modify or suspend the Contest. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. In the event of a dispute, all the Sponsor's decisions are final.
The Contest closes at 11:59pm on December 31, 2007. (the "Contest Closing Date"). Entries and votes not received by the Contest Closing Date will be null and void.
Five (5) Grand Prize finalists will be determined by the total number of Eligible Votes cast for each Submission during the contest period. The five entries that receive the largest number of Eligible Votes during the contest period will be determined to be the finalists. Once five (5) finalists have been determined, the Grand Prize Winner will then be selected from the list of finalists by a judging panel. Judging will take place on or about January 10, 2008. A panel of judges that consist of BC Dairy Foundation representatives will review the Submissions of the five (5) finalists to determine whether they meet the Submission Requirements described above. If a Submission does not meet the Submission Requirements, the judges will disqualify the entrant(s) and the Submission having received the next highest number of votes will be deemed the fifth (5th) finalist. Having determined five Submissions which meet the Submission Requirements, the judges will evaluate those Submissions considering the following criteria:
- Completeness of Submission (i.e. documentary evidence includes pictures, video, statements from coworkers and superiors, etc.) (25 Points)
- Creativity of Submission (i.e. your ability to creatively express how badly you need a recipe makeover) (25 Points)
- Humor (i.e., did you make the panel laugh?) (25 Points)
- Effectiveness of Establishing Your Case (i.e., the panel believes you are a bad cook needing a recipe makeover!) (25 Points)
The judges will then add the points for each criterion and give each Submission a total score. The Submission with the highest score will be selected as the potential Grand Prize winner. In the event of a tie, the Sponsor will select the tied Submission who had the highest total score in the categories of "Humor" and the "Effectiveness of Establishing Your Case." Decisions of the judges are final. Chances of winning will depend on the skill of your Submission, the number of online votes cast for your Submission and the decisions of the Judging Panel in accordance with the criteria set out above.
Before being declared a winner, the selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a time limited mathematical skill testing question to be administered by telephone at a time mutually convenient for the entrant and Sponsor or promotional agent of Sponsor.
4. PRIZE
There is one (1) grand prize available to be won consisting of one three to four (3 - 4) hour cooking lesson in the home of the winner with a professional chef. Prize includes all ingredients required for the meal, rental of dishes, and post-lesson clean-up service. Up to seven (7) guests may accompany the winner in the cooking lesson. Estimated value of the prize is $1,500 CAD.
5. NAMES OF PRIZE WINNERS
For the names of the prize-winners, send a self-addressed, stamped envelope with this request in writing to: BC Dairy Foundation, 3236 Beta Avenue, Burnaby, BC, V5G 4K4, Attention: Real Cream Makeover Contest.
6. PRIVACY
Personal Information collected in connection with this contest will be treated in accordance with BC Dairy Foundation's Privacy Policy, available at www.bcdf.ca.
7. RELEASE
Within fourteen days of receipt thereof, the selected entrant will be required to sign and return the Sponsor's declaration and release form confirming compliance with these rules and acceptance of prize as offered; acknowledging the non-responsibility of the Sponsor, its agents, and the prize suppliers in respect to injuries, accident, loss or misfortune relating to the Contest or the awarding of the prize; and, except where prohibited, acknowledging the Sponsor's and its agents', subsidiaries' or affiliates' right to publish or broadcast the winner's picture, name, address, voices, statements without further compensation other than the prize offered.
8. ERRORS, ETC.
The Sponsor is not responsible for (i) entries which are lost, late, incomplete, postage due, illegible, damaged, destroyed or misdirected; (ii) telephone, technical, network, online, electronic, computer hardware or software failures of any kind; (iii) incomplete, garbled or delayed Internet/e-mail computer transmissions on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof; (iv) any condition caused by events beyond its control which disrupts or interferes with the Contest; or (v) any injury, loss or damage of any kind arising out of participant's participation in the Contest or the acceptance, possession or use of the prize, including without limitation any injury or damage to participant's or any other person's computer relating to or resulting from participation or downloading any materials in this Contest.
CAUTION: ANY ATTEMPT BY ANY PARTY TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. CONTEST MAY BE DISCONTINUED IF THERE IS EVIDENCE OF HACKING OR OTHER TYPES OF SECURITY BREACHES. The Sponsor reserves the right in its sole discretion, to void any and all votes and/or entries of an entrant when the Sponsor believes the entrant has attempted to tamper with or impair the administration, security, fairness or proper play of this contest or website.
The Sponsor extends absolutely no representations or warranties in respect of the prize. If for any reason the Contest is not capable of running as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond its control, the Sponsor reserves the right to cancel, terminate, modify or suspend any portion of the Contest, including, canceling any method of entry, and selecting winner from previously received entries.
The Sponsor reserves the right to amend the terms of this Contest without prior notice if any factor interferes with its proper conduct as contemplated by these Rules.
9. MISCELLANEOUS
Participants who do not comply with these rules are subject to disqualification. Prizes are not transferable and must be accepted as awarded with no substitutions, whether in cash or otherwise, except at the Sponsor's sole discretion. The Sponsor reserves the right to substitute a prize of equivalent or greater value if a prize cannot be awarded as described for any reason. Prizes will only be awarded to a verified winners. All decisions of the Sponsor or its authorized representatives are final and binding in all matters relating to this Contest. All entries become the property of the Sponsor and will not be returned. Contest is subject to all applicable provincial and municipal laws. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by authorized account holder of the email address used on the www.cookingwithcream.com online entry form
